These Terms of Service ("Terms") govern your access to and use of the website operated by SimplyFoundLiving (doing business as SimplyFoundLiving), and the purchase of any products sold through it (the "Site"). By using the Site or placing an order, you agree to be bound by these Terms.

3. Custom & Personalized Products

Most items sold on our Site are handmade and custom-made to order using photos and personalization text supplied directly by you. Because each item is produced individually:

• Minor variations in print color, alignment, cropping, sheen, or finish are inherent to custom production and handmade processes, and do not by themselves indicate a defective product.
• Once production begins, an order cannot be modified, changed, or cancelled.
• All sales of personalized items are final, subject to the remake and damage-resolution windows set out in our Returns & Refunds Policy.

4. User-Submitted Content — Your Photos & Text

When you upload photos or submit personalization text (collectively "User Content"), you represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use the User Content for the purpose of producing and printing your order.
• The User Content does not infringe any copyright, trademark, right of publicity, right of privacy, or any other intellectual property right of any third party (including, without limitation, characters, logos, or images owned by entertainment, media, or sports organizations).
• The User Content is not obscene, defamatory, hateful, harassing, or otherwise unlawful.

We reserve the right, but have no obligation, to refuse to produce any custom order whose User Content we reasonably believe violates these Terms, our community standards, or applicable law.

5. Indemnification

You agree to defend, indemnify, and hold harmless SimplyFoundLiving and its co-founders, employees, contractors, and agents from and against any claim, demand, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) any claim of copyright, trademark, right of publicity, right of privacy, or other intellectual-property infringement based on your submitted User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.

6. Orders & Acceptance

Your submitted order is an offer to buy. We may accept, decline, or limit any order at our sole discretion, including in cases of pricing errors, suspected fraud, or automated system issues. A binding contract is formed only when we send you the official order-shipping or order-confirmation email.

7. Pricing, Payment & Taxes

All prices are shown in USD (U.S. Dollars). Accepted payment methods are displayed securely at checkout. Applicable destination-based sales tax (including Washington State sales tax requirements) is automatically calculated and disclosed before payment is finalized.

8. Shipping & Delivery

Delivery is subject strictly to our Shipping Policy. Estimated delivery times are provided by our shipping carriers (USPS and UPS) and are not guaranteed by us, particularly for made-to-order products that require an additional handcrafting production window.

9. Intellectual Property — Site Content

All content on the Site (other than your personal uploaded User Content) — including logos, product imagery, web copy, layout, and software — is owned by or licensed to SimplyFoundLiving and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may not reproduce, modify, distribute, or publicly display any such content without our prior written permission.

10. Relationship with Shopify

Our Site is hosted on the Shopify platform, operated by Shopify Inc. Shopify provides us with the online e-commerce infrastructure that allows us to display and sell our products to you. Your interaction with the Site is also subject to any applicable Shopify terms; nothing in these Terms transfers responsibility for the platform's technical uptime to SimplyFoundLiving.

11. Limitation of Liability

To the fullest extent permitted by law, SimplyFoundLiving shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site or our custom products. Our total aggregate liability shall not exceed the exact amount you paid for the specific order giving rise to the claim.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States and of the State of Washington, without regard to conflict-of-law principles. Any legal dispute shall be resolved exclusively in the state or federal courts located in the State of Washington, unless a mandatory consumer-protection law of your state of residence dictates otherwise.
